Rights of a Loan Defaulter: What every Borrower should know

Missing a loan payment does not take away your rights as a borrower. A lender can recover legitimate dues, but the recovery process has to follow applicable RBI rules, the loan agreement, and the law.
Knowing these rights can help separate a legitimate recovery process from harassment.

Defaulting on a loan does not mean a lender can use any method it chooses to recover the money. Banks and other RBI-regulated lenders must follow applicable Fair Practices Code requirements and RBI instructions on recovery agents. These rules cover borrower privacy, recovery practices, communication, and grievance handling.

At the same time, these protections do not cancel the borrower’s repayment obligation. A lender can continue to recover legitimate dues through permitted channels. Use the Personal Loan EMI Calculator to plan your repayments carefully and reduce the risk of falling into default in the first place.

Right to be Treated With Dignity

A borrower in default is still entitled to fair treatment. RBI prohibits regulated entities and their recovery agents from using intimidation or harassment during recovery.

This includes verbal or physical harassment, threatening calls, public humiliation, and intrusion into the privacy of the borrower’s family members, referees, or friends. Recovery agents also cannot use false or misleading representations to pressure a borrower into making a payment.

The lender remains responsible for its recovery agents’ conduct.

Right to Reasonable Recovery Call Timing

For recovery of overdue loans, recovery agents and regulated entities must not contact borrowers before 8:00 a.m. or after 7:00 p.m. Repeated calls can also amount to harassment if they are persistent and unreasonable.

These calling-hour restrictions apply to commercial banks, co-operative banks, NBFCs, Asset Reconstruction Companies (ARCs) and All India Financial Institutions (AIFIs), subject to the RBI framework and exclusions such as regulated microfinance loans, which have separate rules.

There is an important distinction here. A borrower does not have a universal right to a separate notice before every recovery step or before a lender files every type of legal proceeding.

However, RBI’s recovery-agent framework requires lenders to inform borrowers about the recovery agent when a default case is handed over for recovery. The recovery agent should also carry the relevant notice and authorisation from the lender, along with identification.

For digital loans, RBI requires the regulated entity to communicate the recovery agent’s details at sanction and again when recovery responsibility is passed to an LSP or another recovery agent.

If a lender intends to take a step that requires a notice under the loan agreement or applicable law, that requirement still applies.

Right to Know the Outstanding Amount Breakdown

You can ask the lender for the details of the amount you are being asked to pay. This can include the overdue EMI, regular interest or overdue interest applicable under the loan terms, permissible penal charges, and other contractual dues.

RBI rules on penal charges require them to be reasonable and imposed under the lender’s board-approved policy. Penal charges cannot be treated as additional principal on which further interest is charged.

If the amount demanded by a recovery agent does not match the lender’s records, ask the lender for an updated statement before paying. Use the Personal Loan Prepayment Calculator to independently estimate the outstanding amount for comparison before accepting the lender’s figure.

Right to Approach the Banking Ombudsman for Harassment Complaints

Complaints under the Reserve Bank-Integrated Ombudsman Scheme, 2026 (RB-IOS, 2026) are handled through the RBI’s updated grievance-redressal framework.

If a bank or eligible NBFC has not resolved your complaint satisfactorily, you can approach the RBI Ombudsman for a qualifying complaint involving deficiency in service.

There is a process to follow. You must first complain to the regulated entity. If it does not respond within 30 days, or you are dissatisfied with its response, you can approach the RBI Ombudsman within the applicable time limit.

You can file complaints through the RBI’s Complaint Management System (CMS), by email, or by physical submission.

What Recovery Agents are NOT Allowed to Do

RBI’s recovery rules prohibit several practices. A recovery agent cannot:

  • Use intimidation or harassment, either verbal or physical.
  • Threaten or abuse the borrower.
  • Publicly humiliate the borrower.
  • Intrude into the privacy of the borrower’s family members, referees, or friends.
  • Make threatening or anonymous calls.
  • Send inappropriate messages through mobile phones or social media.
  • Make false or misleading claims about the loan or recovery process.
  • Make persistent recovery calls that amount to harassment.
  • Call the borrower before 8:00 a.m. or after 7:00 p.m. to recover overdue loans.

How to File a Complaint Against Illegal Recovery

Start with the lender, not just the recovery agent.

Write to the bank or NBFC’s grievance redressal officer and describe exactly what happened. Include call records, messages, emails, screenshots, payment demands, and the recovery agent’s details where available. Ask the lender to investigate the conduct and provide a written response.

If the regulated entity does not resolve the complaint within the applicable 30-day period, or its response does not resolve the issue, you can approach the RBI Ombudsman through the RBI CMS portal.

For serious threats, violence, extortion or other conduct that may constitute a criminal offence, a borrower can also approach the appropriate law-enforcement authority. An RBI complaint does not replace a police complaint where criminal conduct is involved.

Rights Specific to Digital Lending App Borrowers

Digital borrowers have some additional protections under RBI’s digital-lending framework.

The regulated lender must provide key loan documents, including the Key Facts Statement (KFS), sanction letter, terms and conditions, and account statements, through registered communication channels.

The KFS must disclose the Annual Percentage Rate (APR), recovery mechanism, and grievance-redressal details. The regulated entity cannot charge charges not disclosed in the KFS. Compare current rates across lenders on the personal loan interest rate page to verify that your original loan terms were fairly priced before escalating a dispute.

Digital Lending Apps (DLAs) and Lending Service Providers (LSPs) must collect personal data only when it is necessary and with prior, explicit consent. Borrowers must also be able to give or refuse consent for specific uses of their data.

The regulated entity must tell the borrower who is responsible for recovery at the time of sanction and when recovery responsibility is subsequently handed to an LSP.

If a loan app is harassing you, first identify the actual RBI-regulated lender behind the app. The app may be operated by a Lending Service Provider rather than being the lender itself. Once your situation is resolved, use the Personal Loan Eligibility Calculator to assess your eligibility with a verified lender, and the Personal Loan Balance Transfer Calculator to check whether moving any remaining debt to a lower-rate, properly regulated lender makes financial sense. Frequently Asked Questions (FAQs)

Is it legal for a recovery agent to contact my employer or family?

Recovery agents cannot intrude on the privacy of the borrower’s family members, referees, or friends, or publicly humiliate the borrower. Any contact with third parties must also comply with applicable privacy and recovery rules and the terms of the lending arrangement.

What is the RBI Fair Practices Code for loan recovery?

The Fair Practices Code is the framework lenders must follow for fair and transparent lending and recovery practices. It requires lenders to avoid undue harassment and follow applicable rules on borrower communication, recovery agents, privacy, and grievance redressal.

Where can I complain if a recovery agent is harassing me?

First, complain to the lender’s grievance redressal mechanism and keep proof of the complaint. If the regulated entity does not resolve it within the applicable 30-day period or you are dissatisfied with its response, you can approach the RBI Ombudsman through the RBI CMS portal.

Do I have the right to a notice before legal action is taken?

Not in every case. RBI does not require a separate notice before every legal proceeding. Specific notice requirements can arise from the loan agreement, the type of recovery action, and applicable law. Recovery agents, however, must be properly authorized, and borrowers must be given the required information about the recovery agency.

Can recovery agents publicly shame a defaulter?

No. RBI prohibits public humiliation and other forms of intimidation or harassment during loan recovery.

What rights do I have specifically with a digital loan app default?

You have the same basic recovery protections as other borrowers, plus additional digital-lending protections covering data collection, privacy, loan disclosures, and identification of recovery agents. The regulated lender remains responsible for the activities of its Lending Service Providers within the RBI framework.

Can I negotiate a settlement even after being classified as a defaulter?

You can approach the lender and ask about available resolution or settlement options, but the lender is not required to accept a particular settlement proposal. If you agree to a settlement, get the terms and the resulting credit-report status in writing before making the payment.

Does having both secured and unsecured loans improve my credit mix?

A balanced mix of secured and unsecured credit can be viewed positively in credit scoring, but taking a loan solely to improve your credit mix is not advisable. CIBIL also considers several other factors, including repayment history, credit utilization, and inquiries.
